Below and Below are written statement from Philip Young, Major Bill Shaw MBE and Major Bevan Campbell (Air Force Intelligence), all were held in Pul-I-Charki prison around the same time as Anthony. Phil, Bevan has very kindly given his permission to use and post this statement as evidence to support Anthony’s story.

I am Philip Frank Young a w/m, 50 years of age and residing in Cape Town, South Africa.

Between October 2009 and May 2012 I was incarcerated in various detention facilities in Afghanistan. Approximately 2 years of that time period I spent in Pul-e-Charki prison in Kabul. While there I was imprisoned in Block 1 and later in the High Security block. During the period I was in Pul-e-Charki I was not kept separate from the other prisoners and was exposed to most of the other prisoners including the Islamic radicals who formed a large part of the prison population. While some of the radicals were held in isolation, most were imprisoned with the general population.

During my 2 year incarceration in Pul-e-Charki I was witness to various events including the beating and torture of prisoners by prison officials and assault and murder of prisoners by other inmates. In my view, the torture and beating of prisoners by prison officers was systemic and widespread. Prisoners who were not compliant were often handcuffed or chained to fences or other structures, both inside and outdoors. I regularly witnessed prisoners chained outdoors to a fence in the height of winter while wearing no more than the thin traditional garb typical to Afghan men. On many occasions prisoners were chained outside while wearing only trousers. On most occasions these prisoners were left outside with no access to water or food and were left, on some occasions, from sunrise to after sunset. While handcuffed or chained these prisoners were often beaten by prison officials. I witnessed prisoners being beaten with electrical cables and batons for refusing to eat and for “insulting” prison officials. I witnessed 2 prisoners being beaten and dragged from their cell in the early hours of the morning and then dragged, literally, out of the cell block - they were then later executed by hanging in the kitchen of the cell block. (These were the two men convicted of the Kabul Bank massacre in Jalalabad) Again, the brutal treatment of prisoners was systemic and went on with the knowledge of the British mentors. I had a good relationship with the commanders of the blocks in which I was held and they were open about the methods used to “control” prisoners and were quite unaffected by the fact that mentors were on site. While guards and prison officers tended to behave more humanely when around mentors, I witnessed mentors joking and laughing about the beating and inhumane treatment of prisoners.

While incarcerated I was able to acquire a cell phone which I purchased from another inmate. This was very common in the prison and although regular searches were carried out and some phones confiscated, it was quite common that the phones would be replaced within a fortnight or even, in one case I witnessed, returned to the radicals by a prison official. I was approached on numerous occasions by prisoners, both radicals and “normal” prisoners, asking if I wanted to upgrade my phone for a fee of course.  It was common knowledge that radicals were using the cellular phones to plan attacks, communicate with radicals outside of the prison and to control activities of their former terrorist cells from within the prison. While in the High Security wing I had a conversation with a man convicted and jailed for planning and carrying out a bombing attack an act he seemed particularly proud of. He boasted that he was more secure using his cell phone in prison to carry on with his terrorist activities than if he had been outside the prison. When I say common knowledge, I mean that the prison officials knew of it, had reported it to the mentors and Afghan security forces and intelligence officials. I was once questioned by a member of the NDS (National Directorate of Security -  the Afghan intelligence service)  who stated to me that they were aware of the cell phone usage for planning attacks and other terrorist activities but had to rely on the prison officials to locate and confiscate cell phones. This position was ridiculous to me as prison officials were notoriously corrupt and anything could be had - if the price was right and that was certainly common knowledge to every Afghan in the country. They were also quite often sympathetic to the Taliban/Haqqani Network/Al Qaeda and would be the willing couriers of various contraband items, including cell phones. To assume that the western mentors and intelligence agencies were unaware of the widespread cell phone usage to plan and carry out terrorist activities would be naïve in the extreme. On two occasions (that I am aware of) the NDS orchestrated, with the assistance of prison officials, the search of cells within the High Security block. No phones were recovered the first time as we were all aware that a search was to take place the radicals had warned us that a search was to take place. The second occasion a number of phones (5 according to one of the guards) were recovered. The phone of the radical who confessed to me that he operated with impunity within the cell block, was not recovered.

As a South African and because we had no Embassy in Afghanistan the British Foreign and Commonwealth Office (FCO) was responsible for visiting me in the prison and ensuring that I was not mistreated. Their (the FCO) mandate was limited to ensuring that I was not mistreated and that I was as comfortable as possible under the circumstances and that my basic human rights in terms of the UN charter for the treatment of prisoners was adhered to. I received irregular visits (4 in total over the 2.5 years I was incarcerated) The visits ceased when I received a letter stating that the FCO would no longer be able to support commonwealth citizens due to “time restraints”. However the cessation of support from the FCO corresponded with a ban, by the prison authorities, on any vehicles entering the actual prison compound area. This would mean that the FCO staff would be required to park their vehicles (they travelled in a security convoy) outside the prison and then walk the approximately 1km distance to enter the actual inner perimeter of the prison. I do not believe the timing of the cessation of support from the FCO and the vehicle entrance ban, were unrelated. Although the visits by certain members of the FCO were congenial, no member of the FCO did anything to ensure that the court processes were fair and within the bounds of the proper judicial process as laid out in the Statutes and Criminal Procedure Code and other laws and instructions pertaining to the conduct of the courts and judiciary. Visits were purely of a social type with no visible attempt to ensure that British or Commonwealth citizens received the due process of law.

  1. I was arrested on 04 August 2007 in Kabul, Afghanistan, on alleged drug-smuggling charges, and was imprisoned with Anthony Malone during the period from 2007-2009.  During this time we were always allocated to the same rooms/cells as we were amongst the few “Western foreigners” held by the Afghan authorities.

DEPRAVATIONS SUFFERED BY ANTHONY MALONE AND MYSELF

  1. We were often denied food by the prison authorities and the “Boshi” (prisoner elected by the prison authorities to ‘oversee/supervise the prisoners, and activities related to the prison).  The average daily meal consisted of: 1x Loaf of Bread in the mornings; rice was dished up at midday with either beans/chickpeas/carrots/ turnips/cauliflower/tomato + onion, all forming part of a very ‘watery soup’ to go over the rice; whilst at night we had a piece of “meat”, alternating with beans/chickpeas/ carrots/turnips/cauliflower/tomato + onion every alternate day.  Tea was served with every meal.  More often than not, Anthony and I were:-

    1. Served bread that was stale (rock-hard), having to ‘forfeit’ “our fresh bread” to the prison guards to take home as part of “our tax to them”; or bread that had been urinated on/had rodent droppings in/on it.This due to the prison facilities being rodent infested, and the fact that we were regarded as “infidels”;

    2. Denied an adequate amount of food – something we had to fight on a daily basis.Portions were “minimal” to say the least.Generally each of us was served a ladle (average coffee mug) full of cooked rice, with a “splash” of the ‘accompanying soup/sauce’.It must be noted that we were more often than not denied meat (buffalo, camel and/or mutton) due to the fact that neither of us was Muslim.This is something that was encouraged by the prison guards, who subsequently took our rations for themselves.On the rare occasions that we were given “meat”, this would consist of fat and/or bone, again with the encouragement of the prison guards !!

    3. We made numerous representations to the prison authorities about the issues surrounding the quality and quantity of food, but were “laughed off” (literally) as we were “foreigners”.This did change for the better after Jan Eveleigh (the UK Emb Consul) took the matter up with the Pul-i-Charki prison commander (Genl. Barki), but the situation would always “slide back” and revert to what it had been in the past.

    4. It should be noted that a means of getting “extra food” was always possible if one bribed the prison authorities, or had an outsider bring food “in” for you – something that was always subject to a “tax” by the guards – normally One Third to Half of what was being brought “in” for one had to be handed over to the Block Commander and the guards.Another point of interest was that at both “Nazarat Khona” and Taquif” we had to “buy” (10 Afs) our hot water for tea – this was a way for the Commanders to make extra money for themselves.

  2. Health issues were a continuous problem with a complete lack of medical facilities, although the various prisons “flouted” their respective “stocked sickbays” to visiting dignitaries, the prisoners were unable to get the necessary medicines and were forced to purchase medicines from the prison authority “doctors”, who allegedly brought the medication “in” from the outside, when in fact they were selling off medicines donated by the Red Cross and other NGO organisations, all at exorbitant prices.  As “foreigners” we were denied access to medical staff, such as they were, and had to rely on the Red Cross medical staff (in particular Dr Andre – an Italian doctor) for medicines.  I was to suffer with a broken, and rotting, wisdom tooth for close to one year until Jan Eveleigh (the UK Emb Consul) was able to get me to a private dental clinic (Roshan Clinic) – which was for my personal account.  This was NOT only the medical costs, BUT also the cost of the fuel for the ‘official’ vehicle, the “daily rate” of the guards/driver who accompanied me, as well as lunch for all involved in taking me to the clinic.  Again, anything was possible “for the right price”.

  3.  Amenities (bath/shower and toilet) were also denied to us at various stages during our incarceration.  By way of example:  At all Court Proceedings, we, as “foreigners” were denied access to toilet facilities, whilst the local Afghans were allowed to make use of the facilities, using the “need for ablution before prayer” as justification for their use of the facilities but denying us the use.  Another example, was a time when Anthony had an upset stomach, but went outside for the One Hour long “exercise period” we were allowed, otherwise he would have been cooped up for a 48hr period straight, but when he requested to be allowed to make use of the toilet facilities, the guards just laughed at him and refused to let him go, saying he “wanted to go, so had to stay out for the full hour”.  Needless to say the ‘end result’ was not particularly ‘savoury’.  We, as “foreigners”, were only allowed to bathe at the ‘discretion’ of the prison facility commanders, in both, “Nazarat Khona” and “Taquif” – sometimes, as in my case, going without bathing for a period of 26 days straight at “Nazarat Khona”.  At Pul-i-Charki this changed as our respective cells had its own shower (although we often had the water to our bathroom ‘turned off’ to “save water” – all the while the rest of the prisoners were allowed 24hr access to water as “being Muslim, they were required to do ablution before prayers – not so foreigners”).

  4. The lights were kept on 24 hours a day in all the prisons that we were held at, but was specifically ‘enforced’ at the High Security Block we were held in at Pul-i-Charki.  If we dared to switch the lights off we were punished, which could mean that we forfeit our following days exercise, a meal etc.  It is worth noting that whilst Anthony and I were held at the High Security Block in Pul-i-Charki “for our own safety”, this was the Block that held all the Taliban and Al-Qaeda members that had managed to bribe their way out of the Coalition Forces prisons to an Afghan facility where they were able to bribe the local prison officials and carry out military operations against the Coalition Forces with impunity!!

  5. At no time during our incarceration were we ever, I emphasise, ever, given access to an official translator for any dealings with the prison and/or judicial authorities.  This included our respective “interrogations”, “investigations”, “court proceedings” etc.  The fact that the legal system “allows” for this does not necessarily mean that it is/was applied.  In the case of all “foreigners” I encountered during my incarceration, none were ever given access to an ‘official’ (reliable) translator.

  6. Regarding “disciple” and “punishment” by the prison authorities towards us, we were often “targeted” by the various guards for bribes/”gifts” etc, and if we did not acquiesce to their “demands”, they would get the local Afghans to instigate trouble against us.  An example was when Capt Khalik (Taquif) wanted money from us, something we didn’t have, he then got a bulimic prisoner to hurl his vomit at us, not once or twice but on several occasions – all the time watching us and what was going on.  As soon as we grabbed the prisoner and tried to take him to the prison guards so as to make him stop his actions, we were shackled and locked up in stress positions from the prison doors, with the ‘word’ from the prison authorities being that we, as “infidels”, had “dared to attack a Muslim”.  The prisoner who had instigated the matter was allowed to remain ‘free’, with the reason being that “he was crazy”.  On another occasion, an Afghan prisoner started a fight with Anthony, who was subsequently shackled to the doors in a stress position by the prison authorities, but the Afghan prisoner was left free, and then proceeded to spit on Anthony numerous times – all the while with the guards looking on and laughing.

  7. Witnessing torture was an everyday occurrence, with a ANP General (name known) beating prisoners at “Taquif” and then taking them away to the National Directorate of Security (NDS) for further “questioning/interrogation”.  At Pul-i-Charki, we witnessed:-

    1. Prisoners being held in stress positions;

    2. Being doused with cold water from a hose and then left outside overnight in winter – also in a stress position;

    3. The beating of prisoners with Asp batons, not only to the limbs but directly to the head (contrary to safe Standard Operating Procedures for the use of this piece of equipment);

    4. The spraying of teargas into the eyes of prisoners at point-blank range (contrary to safe Standard Operating Procedures for the use of this piece of equipment);

    5. The beating of prisoners on the soles of their feet with a think electric cable (an “old technique” employed by the former Khad, trained by the former KGB);

    6. Prisoners were left in solitary confinement, water switched off to the cell, and denied food/water, and the lights left on 24/7; and

    7. As previously mentioned, we were subject to this behaviour from time-to-time.It is worth noting that when we did raise these issues with the UK Prison Mentors (names known), however, they chose to deny that any such “behaviour” by the guards took place, and stated that if we had issues, to take them up with the relevant Afghan authorities.The only “recourse” we had, was to speak to the US Prison Mentors (CSSP) and inform them of what was going on, it was then that this “behaviour” towards us was halted.In fairness to certain members of the US CSSP programme (names known), they went out of their way to “help/assist” us in making our imprisonment “more bearable”.

Synopsis of Anthony Malone’s deep covert infiltration of the Al-Qaeda and Taliban, Pakistan Taliban networks from within Afghanistan (Continuation of counter-terrorism and intelligence work carried out between 2002-2007)

A)        Between 2007 and 2010 Anthony Malone infiltrated the Al-Qaeda and Pakistan Taliban terrorist networks up to leadership level and their trusted inner circles. This task was requested and ordered by senior American military intelligence stationed in Afghanistan. American senior officers also confirmed that Anthony had top-cover from the American Military/Government. This was for future protection against the British Foreign Office, who at a later date would try and accuse Anthony of being a terrorist and member of the Al-Qaeda, Pakistan Taliban terrorist network.

B)        Conservatively over 100 international terrorist attacks were stopped and disrupted by Anthony covertly feeding intelligence back to American military intelligence ( ****/American Military intelligence and Col ****) Major Campbell has confirm this fact in video interview.

C)        Infiltrating the “Talib Jan” (Who ordered the bombing of the “Finest” shopping centre, just across the road from the UK Embassy, Talib Jan Confirmed these facts in an Video Interviwe with Afghan NDS Intelligence Services) Also Talib Jan confirmed his suicide bombing network being coordinated from within Pul-i-Charkhi Prison Afghanistan. Anthony stopped over 100 suicide and IED attacks on ISAF American and British soldiers in Afghanistan by infiltrating and disrupting the terrorist network. Senior Afghan NDS Security Service officers confirmed information on Talib Jan and the terrorist network operating out of Pul-i-Charkhi prison. The story also printed in the British Daily Telegraph newspaper.

D)        Disrupting and stopping of terrorist attacks also included; the disruption of attacks in several county’s including, America, Saudi Arabia, Iraq, Yemen, Somalia, UAE, Europe and Cyprus.

E)        Anthony identified, while under deep cover within the Al-Qaeda, Pakistan Taliban terrorist network:

  • Weapons and explosives shipments.

  • Hostage locations.

  • HVT and safe house locations.

  • Terrorist leaders travel plans and routes.

  • International terrorist financing systems, including “bank account numbers” and names of front companies used for money laundering.

  • Intelligence concerning the identification and location of IED factories and international terrorists involved in bomb making across the Middle-East and the terrorist areas of operations.

     

    F)         Anthony worked closely with the British SAS Chief of Staff and his Blade Teams, resulting in several terrorist training camps being located in Afghanistan and Pakistan. This intelligence resulted in Air strikes on the camps, a large number of terrorists killed and future terrorist attacks on America and Britain stopped. (Confirmed in meeting between Sergeant Trevor Cooper (Anthony’s operations manager) and SAS Major in Hereford UK). Other task’s received from SAS COS included updates and reports of locations of other HVT’s and terrorist leaders including, Mullah Omar. (Copy of original reports available, Sergeant Trevor Cooper and members of Special Forces are also available to be discreetly interviewed).

     

    G)        Anthony’s deep infiltration also uncovered the Pakistan Taliban plans to detonate a large car bomb in Times Square New York. Intelligence covertly passed back to American Military Intelligence helped stop the 4x4 car bomb, parked in Time Square, before it detonated in a heavily populated area in New York City.

     

    H)        Al-Qaeda plans to attack HRH Queen Elizabeth, and members of the British Royal Family at Buckingham Palace, were intercepted and passed onto British SOCA/NCA in Afghanistan; Anthony gave this information to SOCA/NCA employee ****, long term SOCA/NCA contact and professional contact. **** had passed training with Anthony for the Parachute Regiment 15 years earlier. **** had also previously driven Anthony, covertly, to meetings within military bases with SOCA/NCA in Afghanistan. (**** is a witness to the above facts and information, interview also available).

     

    I)         Al-Qaeda operational note book containing hundreds of real names and contact phone numbers used within the Al-Qaeda, Pakistan Taliban international terrorist network. A copy of this critically important note book was sent by Anthony to British Prime Minister David Cameron at 10 Downing Street London. A copy of the note book was also sent to the Director of MI6 at that time. (Copy of photographs of notebook and other exclusive photographs of inside Afghan Pul-i-Charkhi Maximum security prison are available) Important note; The original note book belonged to AKA Hussien Laghmani, the god-son of 2011 Al-Qaeda leader Al-Z, Hussien was the Quartermaster for AL-Qaeda, Pakistan Taliban and Lashkar e-Taiba operations, including the procurement of Stolen American Stinger missiles. Hussein was responsible for organizing the ordinace, for Lashkar e-Taiba, used in the Mumbai attack.

     

    J)         Anthony’s covert intelligence reports were shown to Col Bob Stewart (MP) by Sergeant Trevor Cooper. Within 15 minutes of reading the reports, Col Bob Stewart arranged for the reports to be taken into an official meeting at MOD HQ Whitehall London with senior MOD officials (all the above were present at the meeting) Copy of reports available. Report included photographs, names, car registration numbers and contact numbers of Pakistani Taliban suicide bombers living in London, UK.

     

    K)        During Anthony’s deep infiltration of the Al-Qaeda network within the Prison environment, over several years, he was officially tasked by American Military Intelligence (“Major” ****).  Tasking’s included the tracing, tracking and locating of Al-Qaeda leaders hiding in Pakistan, several Senior Al-Qaeda Commanders were located, including Al-Qaeda No 1 HVT, UBL. This comprehensive target package was personally handed to American Military Intelligence, ****, by Anthony.  This included; Location of UBL villa in Abbottabad, Pakistan:

  • UBL was also living and slept on the 3rd floor with one of his wives.

  • Other sensitive information and intelligence including military mission options and recommendations.

  • Phone numbers of trusted couriers used by the terrorist network between Afghanistan and Pakistan.

     

    Anthony and Major Campbell’s Personal Diaries confirm the date and location of UBL 8 months before UBL was targeted and killed by American Seal Team 6 at the above location). An “Index List” given to an American lawyer, also confirmed the Location of UBL, as well as a list of intelligence reports handed by Anthony to American Military Intelligence. Major Campbell was witness to the “Index List” being handed over personally by Anthony to a FCO lawyer. The lawyer confirmed that personally handed the “Index List” to ***, senior American Military Intelligence. (Chain of evidence for locating UBL). “Jeff” (pseudonym) the CIA Head of Humint (Human intelligence), based out of the American Embassy (Kabul), was also updated during a covert brief between Anthony and Jeff, which took place in Pul-i-Charkhi Prison. Major Campbell was witness to this meeting as well. Anthony personally updated Jeff on the location of UBL being located in a villa in Abbottabad Pakistan, this was 8 months before UBL was killed by American Special Forces, Seal Team 6.

     

    L)        Major terrorist attack on Kandahar Air Field (KAF) was disrupted from within Pul-i-Charkhi Prison. Hours before the attack, Anthony shorted the electric mains box in the prison block, this while the Al-Qaeda and Taliban were charging their mobile phone, Sat-Com’s/phones and laptop computers, all of which were being used to help coordinate the attack. This resulted in reducing the terrorist Command and Control ability, which resulted in a failed terrorist attack, having the overall effect of leaving the attack disorganized and disjointed. Following the attack, intelligence “confirmed” that the British PM, David Cameron, was sitting on-board a fully fueled military C130 transport aircraft, a mere 400 meters from one of the terrorist attacks which managed to infiltrate the airfield, and made their way to the runway.

     

    M)       Anthony identified and located the main terrorist IED factory and terrorist safe house at Al-Hatera Western Iraq. After an American military Special Forces mission against the target, attacks of American troops diminished within this area.

     

    N)        Malone used his extensive international terrorist network within Pul-i-Charkhi prison, and beyond, to trace and track American Stinger missiles and other SAMs (Surface to Air Missiles). Other military hardware including weapons grade plutonium and other material that terrorist groups were trying to obtain for dirty bombs also became a priority for Anthony and his team, who were directly involved in the counter proliferation of such material.     O)        GPS co-ordinates, and other terrorist Commanders tactical and strategic information was passed by Anthony to ****, who in turn passed information directly to Col **** (American Military Intelligence). Col **** also acknowledged the risk of this task and telephoned **** to thank him for passing on such critically time-sensitive information, which had saved American and British lives.     P)         Anthony ascertained the date and time of a high number of terrorist attacks planned on American soldiers. An example of this was the planned multiple IED attack and sniper ambush on American soldiers (Senior American Intelligence Operatives) visiting Pul-i-Charkhi prison. The attack had been planned and put in place for 1500hrs, location; the Bridge just off Jalalabad Road backing onto the ISAF American base. The attack was disrupted; the American patrol and prison visit were rescheduled. Again American lives were saved. Within the week Anthony had identified a major IED factory, located in shipping-container company on the Jalalabad Road. This terrorist IED factory was posed to launch several attacks on British and American soldiers patrolling along the Jalalabad road from their Forward Operating Bases (FOB).  They also planned to use some of these IED’s to attack soldiers from the American 101st Airborne Division, based in Eastern Afghanistan. The attacks were stopped, IED factory located and destroyed by American Special Forces. Message passed back to Anthony from American military “Job Well Done”.

     

    Q)        Anthony was tasked by American Military Intelligence and Senior British SAS officers and handed over material on several other highly sensitive subjects; this material is confidential due to on going military and international intelligence operations.
